These Terms & Conditions ("Terms") govern your use of our website at switchable.org.uk and any related tools, quizzes, forms, or services made available through it (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

These Terms apply to individual users and consumers only. They do not apply to training providers, commercial partners, or other business parties, who are subject to separate written agreements.

1. Definitions

  • "Platform" means the Switchable website, quizzes, forms, and any related tools or services.
  • "We", "us", or "our" means Switchable Ltd, a company incorporated in England and Wales (Company No: 17052031).
  • "You" or "user" means any individual accessing or using the Platform.
  • "Provider" means any third-party training provider, organisation, or other party to whom we may refer you with your consent.
  • "Services" means any tools, quizzes, assessments, introductions, digital products, or other services offered through the Platform from time to time.

2. About Our Services

We provide information, quizzes, assessments, and introductions designed to help users explore relevant training and career development options based on the answers they provide.

For the avoidance of doubt, the training and career development opportunities described in these Terms include both courses (such as fully funded, self-funded, and loan-funded programmes) and apprenticeships.

Quiz and assessment results are indicative only. They are based solely on the information you provide and do not constitute professional advice of any kind, including careers, legal, financial, or educational advice.

We are not a training provider, employer, or careers service. We do not guarantee the availability, suitability, or quality of any training or opportunity we may introduce you to.

We may share your details with Providers only where you have explicitly requested or consented to being contacted. Any such introduction does not create a contractual relationship between us and those Providers, and we are not responsible for any services they provide. Please see our Privacy Policy for full details of how we handle your data.

From time to time we may offer additional services including digital products or subscription-based content. Where applicable, separate terms may apply to those services and will be presented to you at the point of purchase.

Where digital products or services are offered, your statutory cancellation rights under the Consumer Contracts Regulations 2013 will apply unless you have expressly waived them at the point of purchase.

3. Eligibility and Accuracy of Information

By using the Platform you confirm that you are aged 18 or over and that any information you provide is accurate and complete to the best of your knowledge. If you are under 18 you must not use this Platform. We reserve the right to terminate access if we become aware a user is under 18.

We rely on the information you provide to match you with relevant options. We are not responsible for any outcomes arising from inaccurate or incomplete information you submit through the Platform.

4. Disclaimer

While we aim to provide relevant and accurate information, we do not guarantee:

  • Eligibility for any specific opportunity, course, or training programme
  • Employment, placements, interviews, qualifications, or income of any kind
  • Outcomes, results, or success of any kind following an introduction to a Provider
  • The availability, accuracy, or suitability of any third-party services or content
  • Uninterrupted or error-free access to the Platform

5. Third-Party Providers

Where you choose to be contacted by a Provider, any services they offer are subject to their own terms and conditions, policies, and applicable regulations. We are not party to any agreement between you and a Provider and accept no responsibility for their actions, advice, content, or services.

You should conduct your own due diligence before engaging with any Provider and should not rely solely on any introduction or information provided through the Platform.

6. Use of the Platform

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to:

  • Submit false, misleading, or fraudulent information
  • Attempt to gain unauthorised access to any part of the Platform or its systems
  • Use the Platform in any way that could damage, disable, or impair it
  • Use automated tools or scripts to access or scrape content from the Platform

7. Limitation of Liability

To the fullest extent permitted by applicable law:

  • We are not liable for any indirect, consequential, incidental, or special losses arising from your use of the Platform
  • We are not responsible for any loss or damage arising from your reliance on quiz results, assessments, or information provided through the Platform
  • We are not liable for any outcomes resulting from your engagement with a Provider following an introduction made through the Platform
  • We are not liable for any temporary unavailability of the Platform due to maintenance, technical issues, or circumstances beyond our control
  • Nothing in these Terms affects your statutory rights as a consumer under applicable UK law.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

8. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, quiz content, and design, is owned by or licensed to Switchable Ltd and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from the Platform without our prior written permission.

9. Availability of the Platform

We aim to keep the Platform available and functioning but do not guarantee uninterrupted access. We reserve the right to update, suspend, or withdraw any part of the Platform at any time without notice. We will not be liable for any loss or inconvenience caused by any unavailability of the Platform.

10. Privacy & Cookies

Your use of the Platform is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference. Please review these documents to understand how we collect, use, and protect your personal data.

11. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Platform, our services, or applicable law. Any updates will be posted on this page and the date at the top will be updated accordingly. Your continued use of the Platform following any changes constitutes your acceptance of the updated Terms.

12. Complaints

If you have a complaint about our services, please contact us in the first instance at hello@switchable.org.uk. We will acknowledge your complaint promptly and aim to resolve it as quickly as reasonably possible.

13. Referral Programme

Switchable operates a referral programme through which registered users can refer friends to the Platform. The following rules govern participation.

Eligibility to refer: You are eligible to refer friends if you have submitted a form or application through switchable.careers. There is no requirement to have completed or started a course yourself. The programme is open to UK residents.

Eligibility of referred friends: A referred friend must arrive at the Platform via your unique referral link, submit a qualifying form under their own personal details, and pass the standard Switchable eligibility checks (aged 19 or over, resident in England). A referred friend must be a different person from the referrer. Self-referrals are automatically disqualified.

The reward: When a referred friend achieves a confirmed enrolment on a course through Switchable, the referrer earns a £50 Amazon gift card. The reward is paid to the referrer only. Referred friends do not receive a reward.

When the reward is paid: The reward is triggered by a confirmed enrolment: confirmation by the training provider that the referred friend has started their course. A presumed or pending enrolment alone does not trigger the reward. We aim to deliver your gift card within 7 days of the trigger date.

Reward delivery: Rewards are delivered as Amazon e-gift cards sent to the referrer's registered email address via Amazon.co.uk. Gift cards are non-transferable and have no cash value.

Limits per referrer: We apply a soft cap of 10 successful referrals per 90-day rolling period. Referrals beyond this threshold are held for manual review before any reward is issued.

Fraud and disqualification: We reserve the right to reject or withhold a reward where we reasonably suspect fraud or abuse of the programme. This includes self-referral using different identifying details, coordinated activity using multiple accounts, and any attempt to circumvent programme rules. Where fraud is confirmed, Switchable reserves the right to close the referrer's account.

Tax: You are solely responsible for any tax obligations arising from receiving a reward. Switchable does not provide tax advice.

Changes to the programme: We reserve the right to change programme terms, including the reward amount, eligibility rules, and trigger conditions, or to close the programme at any time. Changes do not apply retroactively to referrals that have already reached confirmed enrolment status.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
